This Payment & Refund Policy governs all financial transactions on the LA CLAVE DE BARRIO platform, currently available via the website and web application at www.laclavedebarrio.com and applies to all users worldwide.
It should be read in conjunction with our Privacy Policy, Cookie Policy, and Terms of Service. Use of the platform indicates acceptance of the above-mentioned policies, provided users have access to and opportunity to review them before using the service.
If and when dedicated mobile applications (iOS and/or Android) are released, this Policy will be updated to describe their specific payment practices.
MJ EVENTS Joanna Szablewska-Crespo Krzycka 80A/8, 53-020 Wrocław, Poland VAT ID (Polish VAT / EU VAT): PL7532279070 Email (general): office@laclavedebarrio.com
Notes on invoicing:
After payment, you will receive a confirmation email and an invoice in electronic (PDF) format.
All invoices comply with Polish VAT regulations. Payment confirmations (receipts) generated by Stripe do not constitute VAT invoices; official VAT invoices are issued by the Service Provider via iFakturownia, using data automatically collected from Stripe.
KSeF (Krajowy System e-Faktur) applies only to invoices issued to Polish business customers (B2B) with a valid Polish VAT ID, where required by applicable law. Invoices to Polish individual consumers (B2C) and to all international customers are issued via iFakturownia in standard electronic (PDF) format, without KSeF.
Invoices are sent to all customers via email in electronic (PDF) format.
Full invoicing rules, including VAT treatment by customer type, are set out in Section 7 (Invoicing).
VAT treatment depends on the customer's location and applicable tax regulations:
The platform provides video-based educational courses via Membership Plan, i.e., subscription.
Membership Plans are tied to the user's account. They are accessible via the website or web application.
All Membership Plan payments are processed exclusively via Stripe.
Once a Membership Plan payment is successfully completed, access to the selected plan is granted automatically and the Billing Cycle begins immediately.
Access to courses under Membership Plan, excluding full-access plan (e.g., ELITE Membership Plan), is provided through a Course Pass system.
A Course Pass entitles the user to activate access to one selected course for the duration of the current Billing Cycle.
Course Passes are allocated according to the selected Membership Plan and may be used to activate any available course within the platform.
Course Passes are valid only for the Billing Cycle in which they are issued and expire automatically at the end of the applicable Billing Cycle, regardless of whether they have been used.
Upon renewal of the Membership Plan and the start of a new Billing Cycle:
The user may activate access to courses within each Billing Cycle using the Course Passes available in that period.
Access to content is provided strictly in accordance with the scope and limitations of the selected Membership Plan.
Full-access plan (e.g., ELITE Membership Plan) provides access to all courses available on the platform during the active plan period.
The Service Provider reserves the right to modify, expand, reduce, or otherwise change the number, scope, structure, and availability of courses and content offered within the platform at any time, provided that such changes do not materially limit access to content already paid for within an active Billing Cycle.
Access to the platform and its content may be temporarily limited due to maintenance, technical updates, or factors beyond the Service Provider's control.
The LA CLAVE DE BARRIO platform offers multiple Membership Plans (i.e., subscriptions) that provide different levels of access to Digital Content. Current details of each Membership Plan, including features and renewal options, are available directly within the platform.
All prices are displayed in euros (€) and are subject to applicable VAT, GST, or other sales tax. The final price is always shown before payment.
The Service Provider reserves the right to change pricing at any time; however, this does not affect active Membership Plans.
All monthly plans renew automatically.
If a billing date does not occur in a given month (e.g., 29 to 31), renewal takes place on the last day of that month.
Annual plans (ELITE) are one-time payments and do not renew automatically. When the one-year access period ends, full access ends; the user may choose to purchase a new Membership Plan at that time or later if they wish to continue.
The Service Provider reserves the right to introduce time-limited promotions, one-time offers, discount codes, or other promotional campaigns. Any such promotions will be reflected on the LA CLAVE DE BARRIO platform and will apply only for the period and conditions displayed at the time of the offer.
Monthly Membership Plans: Renew automatically unless canceled before the end of the current Billing Cycle.
Annual Membership Plan: One-time payment; does not renew automatically. The user may choose to purchase a new Membership Plan at the end of the annual period if they wish to continue.
Any change to a Membership Plan (upgrade or downgrade) affects the Course Pass allocation as described in this Section, depending on whether the change takes effect immediately (upgrade) or at the next renewal (downgrade).
Membership Plan upgrade:
Users may upgrade their Membership Plan at any time via the account settings.
Membership Plan upgrade (immediate): access to courses already activated using Course Passes under the previous Membership Plan remains available until the end of the Billing Cycle applicable to that plan. Any Course Passes from the previous Membership Plan that have not yet been used are added to the Course Pass allocation of the new Membership Plan, and all Course Passes (carried over and newly granted) become valid until the end of the Billing Cycle of the new plan.
If the upgraded Membership Plan includes full access to all available courses (e.g., ELITE Membership Plan), all available courses are unlocked automatically, giving instant access to the entire course library without using Course Passes.
Where the upgraded plan is a full-access plan (e.g., ELITE), any previously unused Course Passes become moot, since ELITE provides unrestricted access to the entire course library; such passes are not separately carried over or refunded, as full access already exceeds their value.
The user is charged the full price of the upgraded Membership Plan at the time of upgrade. No partial, prorated, or discounted pricing applies unless explicitly stated in a separate offer.
Membership Plan downgrade:
Membership Plan downgrade (scheduled): Users may schedule a downgrade to a lower Membership Plan at any time via account settings. A scheduled downgrade does not take effect immediately and does not trigger any charge at the time it is scheduled. The user retains full access to their current Membership Plan, including all activated courses and remaining Course Passes, until the end of the current Billing Cycle. At the end of the current Billing Cycle, instead of renewing the previous plan, the new (lower) Membership Plan is activated and the corresponding price is charged at that time. Before the scheduled downgrade takes effect, the user may change their mind at any time: they may keep their current plan, select a different plan, or upgrade (which takes effect immediately, as described above).
Users may cancel their Membership Plan at any time via their account settings.
Cancellation prevents the plan from renewing for the next Billing Cycle.
Once the Membership Plan is cancelled, the user's access, including any activated courses and unused Course Passes, will remain available until the end of the current Billing Cycle applicable to the cancelled plan.
If the user decides to change or renew their Membership Plan after cancellation, the rules described in Section 4.2 (Membership Plan Change) shall apply.
If the user cancels their Membership Plan but changes their mind before the end of the current Billing Cycle, they may reactivate the same plan at any time before that date, free of charge, via account settings. Reactivation resumes automatic billing from the next Billing Cycle onward, with no interruption to the user's existing access.
Even after a Membership Plan has fully expired, the user's account remains accessible to view payment history and browse the course catalog, without access to paid lessons.
If a renewal or scheduled plan-change payment cannot be successfully processed, the user's access continues until the end of the period already paid for; no additional access is granted for the new Billing Cycle until payment succeeds. The Service Provider, via its payment processor (Stripe), will attempt to retry the payment up to 3 times. If a retry succeeds, the new Billing Cycle begins normally. If none of the 3 attempts succeeds, the Membership Plan is cancelled and access to paid Digital Content ends accordingly.
If a user initiates a chargeback or otherwise disputes a payment directly with their card issuer or bank, instead of contacting the Service Provider through the channels described in this Policy, the Service Provider reserves the right to immediately suspend access to the Membership Plan and any associated Digital Content until the dispute is resolved. Where a chargeback is found to be unjustified (for example, where the disputed payment corresponds to Digital Content that was in fact accessed and used, and no refund would otherwise be due under this Policy), the Service Provider reserves the right to seek recovery of any costs, fees, or losses resulting from the unjustified chargeback, without prejudice to the user's statutory rights.
Due to the nature of digital content, refunds are generally not provided once access to the content has started.
Access is considered to begin immediately after successful payment.
By purchasing, the user consents to immediate access to digital content.
EU/EEA Users: the right of withdrawal does not apply once access to Digital Content has started, in accordance with Article 16(m) of the Consumer Rights Directive (2011/83/EU), provided the user has given prior express consent to immediate performance and has acknowledged the resulting loss of the right of withdrawal.
Non-EU / Global Users: Refund rights determined by local law. Generally, no refunds after content access begins.
Exceptions: Refunds may be considered only in cases of:
Prices displayed on the platform are shown as net amounts, with applicable taxes (including VAT, GST, or sales tax) calculated separately based on the user's location.
The applicable tax amount is automatically calculated during the checkout process using a payment processing system (Stripe), based on the information provided by the user and applicable tax regulations.
The calculated tax is added to the final price before payment is completed.
Payments may be processed in a currency different from the user's local currency. Any currency conversion rates or additional fees applied by the payment provider (Stripe) or the user's bank are outside the control of the Service Provider.
The total price, including all applicable taxes, is clearly presented to the user prior to confirming the payment.
While tax calculation is performed using automated systems, the Service Provider remains responsible for compliance with applicable tax regulations.
VAT is applied in accordance with applicable European Union VAT regulations for digital services.
Depending on the place of taxation as determined under applicable law, VAT may be charged based on the Service Provider's country of establishment or based on the customer's country of residence.
The method of VAT calculation is determined by the Service Provider in accordance with applicable legal obligations and may change over time.
The reverse charge mechanism applies where a valid VAT identification number is provided, and the VAT ID is successfully verified.
Where reverse charge applies, VAT is not charged by the Service Provider, and the customer is responsible for accounting for VAT in their own jurisdiction.
The customer bears full responsibility for providing accurate and complete VAT information at the time of purchase.
VAT may not be applied to customers located outside the European Union.
However, local taxes, digital service taxes, or similar indirect taxes may apply depending on the customer's jurisdiction.
The customer is responsible for compliance with any local tax obligations where applicable.
VAT invoices are issued by the Service Provider using iFakturownia based on the data provided by the customer at the time of purchase via Stripe.
Invoices are issued without undue delay following payment confirmation, in accordance with applicable legal requirements, and are delivered electronically to the customer's email address.
Invoice data is derived from information provided during checkout in Stripe.
The customer is solely responsible for ensuring that all billing details, including business information and VAT identification number (if applicable), are accurate, complete, and provided at the time of purchase.
Billing details cannot be modified retroactively for the purpose of changing the VAT treatment of a completed transaction.
The Service Provider reserves the right to determine the appropriate invoicing method and format in accordance with applicable tax laws.
The structure, format, and content of invoices may vary depending on the customer's location, tax status, and applicable legal requirements.
VAT invoices for customers located in Poland are issued in accordance with Polish VAT regulations.
KSeF (Krajowy System e-Faktur) applies only to invoices issued to Polish business customers (B2B) with a valid, verified Polish VAT ID, where required by applicable law.
Invoices to Polish individual consumers (B2C) are issued via iFakturownia in standard electronic (PDF) format; KSeF does not apply to these invoices. In cases where KSeF is required for a B2B invoice but temporarily unavailable, that invoice may be issued in standard electronic (PDF) format on a provisional basis.
VAT invoices for EU consumers are issued in electronic format (PDF).
VAT is applied in accordance with applicable EU VAT rules, as described in Section 6.
The invoicing method reflects the applicable place of taxation as determined under relevant regulations.
Where a valid and verifiable VAT identification number is provided, invoices are issued without VAT under the reverse charge mechanism.
A valid VAT ID must be provided at the time of purchase; it cannot be applied retroactively.
Invoices are issued in electronic format (PDF).
For customers outside the European Union, invoices or equivalent tax documents are issued in electronic format (PDF), where applicable.
VAT may not be applied depending on the place of taxation; however, local tax obligations may apply in the customer's jurisdiction.
Any complaints related to payments, Membership Plans, or access to the platform may be submitted via the designated support channels, including:
The Service Provider will review and process complaints without undue delay, and no later than within 14 days from the date of receipt.
If additional information is required to process the complaint, the response period may be extended accordingly, and the user will be informed.
Submission of a complaint does not affect the user's statutory rights under applicable consumer protection laws.
The Service Provider reserves the right to update or modify this Policy at any time, in particular due to:
Any updated version of this Policy becomes effective upon its publication on the platform, unless a different effective date is specified.
Where required by applicable law, users will be informed of material changes in advance.
Continued use of the platform after the updated Policy becomes effective constitutes acceptance of the revised Policy.
This Policy is governed by the laws of Poland, without prejudice to any mandatory consumer protection rights applicable in the user's country of residence.
The parties shall make reasonable efforts to resolve any disputes arising from this Policy through amicable negotiations prior to initiating formal legal proceedings.
If a dispute cannot be resolved amicably:
Nothing in this Policy shall limit or exclude any rights granted to consumers under applicable laws, including the right to seek redress before competent judicial or administrative authorities.
